Beginning August 30th, 2018, your business must comply with revised regulations under Proposition 65 (CA).
What is Proposition 65?
Proposition 65 requires businesses to comply to provide notifications regarding certain harmful chemicals that have been linked to cancer and/or birth defects. Beginning August 30th, 2018, revised Prop 65 regulations go into effect, which update the specific safe harbor warning requirements to better communicate warnings to consumers.
These warnings must contain but are not limited to:
- “WARNING” verbiage prominently displayed on the product page
- The name of at least one harmful chemical that prompted a warning
- Triangular warning symbol prominently displayed on the product page
- Short or long tail description of the hazardous effects of the chemical(s) in question
Read more about the warnings here.
How Do These Changes Affect Your Parts Selling Site?
Your parts site likely sells at least a few parts and products that contain a chemical on the list from OEHHA. As an online seller who has customers in California, you are legally obligated to warn users before buying a product that contains one of the listed chemicals that may cause cancer or reproductive harm. Internet retailers must provide separate warnings for parts sold online, even if a warning appears on the actual product as well. In order to comply with the revised warning requirements, you will need to display a warning that includes the name of at least one Prop 65 chemical in the affected product, including one chemical for each category of cancer and reproductive harm. To obtain the information required for the warning, you should contact your manufacturer to obtain the relevant information for impacted products, follow the warning verbiage used by your manufacturer, and provide at least one chemical found in the specified product in each applicable category.
